By using my website, you, the person using this website (hereinafter: ‘the user’), agree to our policy. Please read these policies carefully before using my website. This Privacy Policy explains how Kate Callaghan (“I”, “me”, “my”) collects, uses and protects personal information when you visit katecallaghanauthor.com (the “Website”), purchase my books, subscribe to my newsletter, contact me, or follow links to third-party book retailers.

I am based in Ireland and process personal data in accordance with applicable data protection law, including the EU General Data Protection Regulation (GDPR) and the Data Protection Act 2018.

Who I am

The data controller responsible for your personal data is:

Kate Callaghan
Ireland
Email: katecallaghan@callaghanwriter.com

If you have any questions about this Privacy Policy or how I use your personal data, please contact me at the email address above.

Personal information I collect

Depending on how you interact with my Website, I may collect: your name, email address, billing address, delivery address, telephone number, where necessary for delivery or contacting you about an order, details of books you purchase, order and transaction information, information you provide when contacting me, information you provide when subscribing to my newsletter, information you provide when entering a competition or giveaway, technical information about your device and use of the Website, information collected through cookies and similar technologies, where applicable. I may also process personal information in the form of comments, images, or videos that the User makes or shares on our blogs, social media pages, or any other online forum. I only collect personal information that is reasonably necessary for the relevant purpose.

Purchasing books directly from my Website

When you purchase a book directly from my Website, I process the information necessary to accept, process and fulfil your order. This may include your name, email address, billing address, delivery address, order details and information necessary to arrange delivery. Payments are processed securely by Stripe. I do not normally receive or store your complete payment card details. I personally pack and post some orders. Where an order is fulfilled through a third-party fulfilment or distribution service, including IngramSpark, I may share the information necessary to fulfil and deliver the order with that service. I may also share relevant information with postal or delivery providers where necessary to deliver your order. I use order information to process and fulfil purchases, arrange delivery, communicate with you about your order, deal with returns, refunds or customer-service enquiries; and maintain appropriate accounting, tax and business records.

Payment processing

Stripe processes payments made through the Website. Stripe processes your payment card information and does not normally store it in full. Stripe may collect and process payment and transaction information in accordance with its own privacy policy and applicable data protection requirements.

Newsletter

My newsletter is provided through Squarespace Email Campaigns. If you subscribe to my newsletter, I may collect your name and email address and use this information to send you newsletters and other communications about my books, writing, events and related activities.

Where consent is required, I will only send marketing communications after you have provided the appropriate consent. You can unsubscribe at any time by using the unsubscribe link included in my emails or by contacting me at katecallaghan@callaghanwriter.com. Unsubscribing from marketing emails will not affect necessary transactional communications relating to an order you have placed.

How I use personal information

I may use personal information to process and fulfil book orders, arrange delivery of books, communicate with customers about purchases, provide customer support, send newsletters and marketing communications where permitted, administer competitions, giveaways or promotions, respond to enquiries, operate and maintain my Website, improve my Website and services, maintain appropriate business, accounting and tax records, protect the Website and my business against fraud, misuse or security threats; and comply with legal obligations.  If the User fills out the “contact us” portion of the Website, or provides me with any other communication data, including but not limited to that provided via email, social media messaging or posts, or text messages, the Website may collect personal information including their name, email address, phone number, the information the User shared with that social media platform, as well as the text of any message sent electronically. This data will be processed based on the Website’s interest in communicating with the User.

Legal bases for processing

Depending on the circumstances, I rely on one or more of the following legal bases under the GDPR:

Contract: I process information where necessary to enter into or perform a contract with you, such as processing and fulfilling an order for a book.

Consent: I process information on the basis of your consent where required, for example when you subscribe to my newsletter or consent to certain non-essential cookies.

You can withdraw consent at any time. Withdrawal does not affect processing that took place before consent was withdrawn.

Legitimate interests: I may process information where necessary for my legitimate interests in operating my author business, responding to enquiries, maintaining Website security and improving my services, provided those interests are not overridden by your rights and freedoms.

Legal obligation: I may process and retain information where necessary to comply with legal, tax, accounting or regulatory requirements.

Book retailers and external links

My Website contains links to third-party book retailers, including Amazon and other book retailers.

Some links are ordinary links. Other links may be affiliate links, meaning I may receive a commission if you click an affiliate link and subsequently make a qualifying purchase. Where I use affiliate links, I will identify them appropriately on the Website. When you click a link to a third-party retailer, you leave my Website and that retailer may collect and process your personal information in accordance with its own privacy policy, terms and cookie policies. I do not control the privacy practices of third-party retailers. Purchases made directly from a third-party retailer are subject to that retailer's own terms, privacy policy and processing practices.

Fulfilment and distribution

Books may be fulfilled or distributed through third-party services, including IngramSpark, where applicable. Where a third party needs personal information to fulfil and deliver an order, I may provide the information reasonably necessary for that purpose, such as your name, delivery address, email address and order details. I will not provide more personal information than is reasonably necessary for fulfilment.

Service providers

To operate my Website and author business, I may use third-party service providers, including:

Squarespace — Website hosting, ecommerce and newsletter services; Stripe — payment processing; IngramSpark — book fulfilment and distribution, where applicable; postal and delivery providers — where required to deliver orders; IT and technical service providers; and accounting, legal or professional advisers where appropriate. I may also disclose personal information where required to do so by law or where necessary to protect my legal rights, the Website or other persons.

Cookies and similar technologies

My Website is operated using Squarespace and uses cookies and similar technologies.

Some cookies are necessary for the Website to function, including features relating to security, shopping carts, checkout and other essential Website functions.

International transfers

Some companies and service providers I use may process personal information outside Ireland or the European Economic Area (“EEA”). Where personal data is transferred outside the EEA, I will ensure that the transfer is made in accordance with applicable data protection law and that appropriate safeguards are used where required.

How long I keep personal information

I retain personal information only for as long as reasonably necessary for the purposes for which it was collected, unless a longer period is required by law. Newsletter information is generally retained until you unsubscribe, subject to applicable legal requirements. Order and transaction information may be retained for the period necessary to administer purchases and comply with accounting, tax and legal obligations. Customer correspondence may be retained for a reasonable period where necessary for customer service, record-keeping or legal purposes.

Your data protection rights

Under the GDPR, you may have the right to: request access to personal information I hold about you; request correction of inaccurate information; request deletion of your personal information in certain circumstances; request restriction of processing in certain circumstances; object to certain processing; request portability of certain personal information; and withdraw consent where processing is based on consent. These rights are subject to certain legal conditions and exemptions.
